2. About BizBee Funding

BizBee Funding is a business funding marketplace that connects small business owners with a network of third-party lending partners. BizBee Funding is not a lender and does not make credit decisions or fund loans directly.

3. SMS and Phone Communication Terms

By checking the opt-in box on our application form, you agree to receive automated SMS text messages and phone calls from BizBee Funding at the phone number you provide. Messages will relate to your funding application, application status, document requests, and support. Message frequency is up to 4 messages per month. Message and data rates may apply.

To opt out of SMS messages at any time, reply STOP to any message you receive from us. After opting out you will receive one confirmation message and no further SMS communications. To request help, reply HELP to any message or contact us at support@bizbeefunding.com.

Consent to receive SMS messages or phone calls is not required as a condition of submitting an application or receiving funding.

Your phone number and SMS opt-in information will not be sold or shared with third parties for their marketing purposes.

4. No Guarantee of Funding

Submitting an application through BizBee Funding does not guarantee approval or funding. Lending decisions are made solely by our third-party lending partners based on their own underwriting criteria.

5. Third-Party Lenders

BizBee Funding works with a network of independent third-party lenders. We are not responsible for the terms, decisions, or actions of any lending partner. Review all loan terms carefully before accepting any offer.

6. Intellectual Property

All content on bizbeefunding.com is the property of BizBee Funding and may not be reproduced without written permission.

7. Limitation of Liability

BizBee Funding is not liable for any damages arising from your use of this website or reliance on information provided herein.

8. Changes to These Terms

We may update these Terms of Service at any time. Continued use of the site after changes constitutes acceptance of the updated terms.

These Business Financing Connection Services Terms and Conditions ("Terms and Conditions" or "Agreement") are applicable in connection with any business funding inquiry, application, or request for financing information ("Request for Business Financing") submitted by or on behalf of any business entity through BizBee Funding, LLC's digital platform and associated services.

As used herein, "BizBee Funding," "BizBee," "we," "us," or "our" refers collectively to BizBee Funding, LLC, its subsidiaries, affiliates, and associated entities operating under the BizBee Funding brand.

1. Business Financing Connection Services and Platform Operations

BizBee Funding operates as a comprehensive business financing connection platform and information services provider that facilitates connections between business entities seeking various forms of commercial financing and a network of qualified funding providers, financial institutions, alternative lenders, and commercial finance companies (collectively, "Funding Partners" or "Partners"). Our platform provides sophisticated matching algorithms, financial analysis tools, and comprehensive application processing services designed to optimize funding opportunities for our clients.

While BizBee Funding maintains extensive relationships with numerous funding sources and provides comprehensive application processing and evaluation services, we operate as an independent intermediary platform facilitating connections within the commercial financing marketplace. Our role encompasses application processing, preliminary financial analysis, document preparation, Partner matching services, and ongoing client consultation throughout the financing evaluation process.

Important Disclosure: BizBee Funding does not directly originate loans, provide funding from our own capital, make final underwriting decisions, or maintain fiduciary obligations to any particular funding outcome. All final funding decisions, terms, conditions, and approval determinations remain solely within the discretion of our Funding Partners.

2. Eligibility Requirements and Client Representations

2.1 Minimum Eligibility Standards

To utilize our services, you must meet the following requirements:

• You must be at least eighteen (18) years of age and possess legal capacity to enter into binding contractual agreements;
• You must be a legal resident of the United States or its territories, or an authorized representative of a business entity organized under United States jurisdiction;
• Your business entity must be legally organized, registered, and operating in compliance with all applicable federal, state, and local regulations;
• You must possess requisite authority to submit financing requests and bind the business entity to potential funding agreements.

2.2 Material Representations and Warranties

By utilizing our services, you represent, warrant, and covenant that all information provided is true, accurate, complete, and current. You acknowledge that Funding Partners will rely upon these representations in making credit and funding determinations. False or misleading information may result in immediate termination of services and potential legal consequences.

3. Platform Operations and Service Delivery Methods

3.1 Application Processing Services

BizBee Funding provides the following application processing services:

• Comprehensive business and personal information collection through our secure digital platform;
• Advanced financial analysis and creditworthiness assessment;
• Document verification and authentication services;
• Preliminary qualification and Partner matching algorithms.

3.2 Partner Network Integration

Our platform facilitates the following integrations with our Funding Partner network:

• Secure transmission of qualified applications to appropriate Funding Partners;
• Ongoing communication facilitation between clients and Partners;
• Status monitoring and progress tracking throughout the evaluation process;
• Operational communications related to your Request for Business Financing, including application updates, requests for information, and appointment scheduling.

4. Comprehensive Authorizations and Consents

By utilizing our services, you hereby provide the following comprehensive authorizations:

4.1 Credit Report Authorization

You authorize BizBee Funding and all Funding Partners to obtain, review, and utilize personal and business credit reports from any consumer or commercial credit reporting agencies, including but not limited to Experian, Equifax, TransUnion, and Dun & Bradstreet, both initially and on an ongoing basis as deemed necessary for evaluation purposes.

You understand that by submitting your information, you are providing written instructions authorizing BizBee Funding, LLC and its service providers and partners to obtain your personal credit profile or other information from consumer reporting agencies under the Fair Credit Reporting Act (FCRA) for the purpose of conducting a credit pre-qualification. You understand this will be a soft inquiry and will not affect your credit score.

4.2 Information Sharing Authorization

You authorize BizBee Funding to share, transmit, and disclose any and all provided information, documentation, and analysis results to appropriate Funding Partners, their affiliates, service providers, and associated third parties involved in the financing evaluation process.

For clarity: BizBee Funding is the only sender for BizBee Funding SMS; Funding Partners do not send SMS from BizBee Funding numbers unless you separately opt in directly with that Partner.

4.3 Background Investigation Authorization

You authorize comprehensive background checks, business verification investigations, bank account analysis, and any additional due diligence procedures deemed necessary by BizBee Funding or Funding Partners in connection with your financing request.

4.4 Communication Authorization

You may receive communications from BizBee Funding and/or Funding Partners regarding your Request for Business Financing. BizBee Funding will send SMS/text messages only if you explicitly opt in by checking an unchecked SMS consent checkbox on our forms. BizBee Funding SMS messages are limited to application confirmations, requests for missing information, identity verification steps, appointment scheduling, and status updates. Message frequency is up to 4 messages per month. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. Consent is not a condition of purchase. BizBee Funding does not sell or share mobile numbers or SMS opt-in/consent data with third parties or affiliates for their own marketing or promotional purposes. Funding Partners may contact you by phone or email based on your submission and their underwriting processes.

5. Information Collection, Usage, and Retention Policies

BizBee Funding collects, processes, and maintains extensive business and personal information necessary for financing evaluation purposes. This information includes, but is not limited to: business financial statements, tax returns, bank statements, credit card processing statements, personal financial information, ownership documentation, business licenses, and any additional documentation requested during the evaluation process.

5.1 Permitted Information Usage

• Financing evaluation and Partner matching services;
• Credit and risk assessment procedures;
• Regulatory compliance and reporting obligations;
• Platform improvement, analytics, and service enhancement.

5.2 Information Retention Standards

Information may be retained for compliance, audit, fraud-prevention, and service-improvement purposes in accordance with applicable law. Mobile numbers collected for SMS are not retained or used for third-party marketing lists and are handled in accordance with our Privacy Policy.

5.3 Collection of Personal Information

You also understand that by providing your contact information you are providing written instruction authorizing BizBee Funding and affiliates to obtain your personal credit profile or other information from credit reporting agencies under the FCRA solely to conduct a credit pre-qualification with just your name, phone and email. This is generally considered a soft inquiry and typically does not impact your credit score.

5.4 Text Messaging (SMS) Terms

SMS Opt-In Data: We do not share, sell, rent, or disclose mobile numbers or SMS opt-in/consent data to third parties or affiliates for their own marketing or promotional purposes. How You Opt In: If you provide your mobile number and opt in (for example, by checking an unchecked SMS consent box on our forms), BizBee Funding may send you text messages related to your request, including application confirmations, requests for missing information, identity verification steps, appointment scheduling, and status updates. 6. Funding Partner Network and Relationship Disclosures

BizBee Funding maintains strategic relationships with numerous funding providers, including but not limited to traditional banks, alternative lenders, equipment financing companies, merchant cash advance providers, invoice factoring companies, and specialized commercial finance institutions. These relationships may include various compensation arrangements, referral agreements, and strategic partnerships that benefit BizBee Funding.

Important Partner Relationship Disclosures:

• BizBee Funding may receive compensation from Funding Partners for successful referrals, which may influence Partner selection and recommendation priorities;
• Certain Funding Partners may be affiliates or have ownership interests related to BizBee Funding;
• Partner selection algorithms consider multiple factors including compensation arrangements, approval likelihood, and terms competitiveness;
• You are encouraged to independently evaluate all funding offers and are under no obligation to accept any particular Partner's terms.

7. Comprehensive Liability Limitations and Service Disclaimers

7.1 Service Disclaimers

• No guarantee of funding approval or specific terms;
• No warranty regarding Partner response times or service quality;
• No responsibility for Partner decisions, actions, or business practices;
• No liability for changes in credit scores or financial standing resulting from credit inquiries;
• Services provided on an "as-is" and "as-available" basis without warranties of any kind.

8. Governing Law and Jurisdictional Provisions

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to this Agreement or your use of our services must be brought exclusively in the state or federal courts located in Ventura County, California.

By accepting these Terms and Conditions, you:

• Consent to the personal jurisdiction of California courts;
• Waive any objection to venue in Ventura County, California;
• Acknowledge that California law applies regardless of your physical location;
• Recognize that federal law preemption applies where applicable.

9. Mandatory Binding Arbitration and Class Action Waiver

9.1 Arbitration Procedures

• Arbitration shall be conducted in Ventura County, California;
• A single arbitrator shall be selected in accordance with AAA procedures;
• Discovery shall be limited to expedite proceedings and reduce costs;
• The arbitrator's decision shall be final and binding on all parties;
• Limited grounds for appeal exist under applicable California law.

10. Additional Terms and General Provisions

10.1 Modification Rights

BizBee Funding reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. All modifications become effective immediately upon posting to our website or platform. Your continued use of our services following any modification constitutes acceptance of the modified terms.

10.2 Severability

If any provision of this Agreement is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Any invalid provision shall be reformed or construed to achieve its intended purpose to the maximum extent permitted by applicable law.

10.3 Assignment

BizBee Funding may freely assign, transfer, or delegate this Agreement and any rights or obligations hereunder without notice or consent. You may not assign your rights or obligations under this Agreement without our prior written consent, which may be withheld in our sole discretion.

10.4 Statute of Limitations

Any claim or cause of action arising under this Agreement must be commenced within one (1) year after the cause of action arises, regardless of when the injury is discovered. Any claim not brought within this period shall be permanently barred.

10.5 Entire Agreement

This Agreement, together with any privacy policy and other documents expressly incorporated by reference, constitutes the entire agreement between you and BizBee Funding concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and communications.

10.6 Waiver

No waiver of any provision of this Agreement shall be deemed or shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. No failure to exercise any right or remedy shall operate as a waiver thereof.
